Terms of Use Agreement & Privacy Policy

PART 1: DEFINITIONS

For purposes of this Agreement:

"Agreement" means these Terms of Use and Privacy Policy, as updated from time to time by WT.

"Company" means Window Three LLC, doing business as BeThree Coaching (WT), an Indiana limited liability company.

"Platform" means the BeThree Coaching Platform, accessible at BeThree.com, including all content, videos, resources, and live coaching sessions.

"User" means any person who accesses or uses the Platform, whether directly or through access provided by their employer.

"Services" means access to the Platform, recorded content, live coaching sessions, and related materials as described herein.

"Personal Information" means any information you provide or that we collect in connection with your use of the Platform.

"Intellectual Property Rights" means all copyrights, trademarks, and other rights in any content or materials provided through the Platform.

PART 2: SERVICE DESCRIPTION

The Platform provides Users with:

  1. Access to Season One and Season Two of the BeThree Coaching Platform for the duration of their enrollment.

  2. Live, interactive coaching sessions (digital or telephonic) delivered by WT personnel, subject to your employer’s service plan and limits.

  3. Coaching resources, video content, and related materials, for personal and professional development.

  4. No Accreditation or Guarantees – The Platform provides educational and coaching services. WT does not offer external accreditation, guarantee results, or provide professional legal, medical, psychological, or financial advice.

PART 3: IDEOLOGY & CONTENT ADVISORY

  1. The BeThree Coaching Platform may include discussions that touch on moral, political, religious, and philosophical topics, as well as personal opinions of WT presenters.

  2. Content may also include language some individuals may find objectionable, used for emphasis or authenticity in the coaching context.

  3. Participation is voluntary. By using the Platform, you acknowledge that:

1. Exposure to such viewpoints and language is intentional and integral to the program’s delivery.

2. This does not constitute harassment, discrimination, or endorsement by WT or your employer.

3. You may discontinue participation at any time.

PART 4: USER OBLIGATIONS

Users agree to:

  1. Access the Platform only for personal, non-commercial use.

  2. Keep login credentials confidential.

  3. Not record, copy, share, or redistribute Platform content without WT’s written consent.

  4. Refrain from disruptive or inappropriate behavior in live sessions.

  5. Comply with all applicable laws.

  6. WT reserves the right to remove or restrict any User’s access for violation of these obligations without refund.

PART 5: INTELLECTUAL PROPERTY RIGHTS

  1. All Platform content, including but not limited to videos, guides, course materials, and live coaching, is the sole property of WT and protected by copyright and other intellectual property laws.

  2. You are granted a limited, non-exclusive, non-transferable license to use the Platform content solely for your own personal development.

  3. You may not:

  4. Reproduce, duplicate, sell, or otherwise exploit any WT content.

  5. Remove any copyright or trademark notices.

  6. Use WT branding (“B3 Coaching” or “BeThree Coaching”) to promote unauthorized programs.

  7. Violation of this section may result in immediate termination and legal action.

PART 6: PAYMENTS & REFUNDS

  1. If you access the Platform through an employer program, payment terms are governed by that employer’s agreement with WT.

  2. For direct purchasers:

  3. Fees are payable in advance and non-refundable, except as determined by WT in its sole discretion.

  4. Any refunds are one-time, case-specific, and do not set precedent.

PART 7: DISCLAIMERS & LIMITATION OF LIABILITY

  1. WT makes no guarantees regarding specific results or outcomes from use of the Platform.

  2. The Platform is provided “as is” without warranties of any kind.

  3. WT shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

PART 8: PRIVACY POLICY

Information We Collect:

  1. Your account and profile information.

  2. Classes taken, participation in coaching, and related engagement data.

  3. Technical data (IP address, device/browser information, cookies).

  4. Payment information (if applicable).

How We Use Your Information:

  1. Provide, manage, and improve the Platform.

  2. Communicate with you about your account or services.

  3. Ensure compliance with these Terms.

  4. Conduct analytics and research.

  5. Data Sharing

  6. We do not sell or rent your personal information.

We may share it with:

  1. Service providers under confidentiality agreements.

  2. Legal authorities if required by law.

  3. Data Retention

  4. We retain personal information only as long as necessary for the purposes described above or as required by law.

  5. Security

  6. We use reasonable technical and organizational measures to protect your data. No method of storage or transmission is 100% secure.

PART 9: TERMINATION

WT may suspend or terminate your access for:

  1. Breach of these Terms.

  2. Inappropriate conduct in live sessions.

  3. Misuse of Platform content.

  4. Upon termination, your license to use the Platform content immediately ends.

PART 10: MODIFICATIONS

WT may update these Terms at any time. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

PART 11: GOVERNING LAW

This Agreement is governed by the laws of the State of Indiana, without regard to its conflict of law provisions.
